Data Processing Agreement: version archive

Why this page exists

Clause 1.5 of the MyGatePass Data Processing Agreement commits us to keeping a dated archive of every published version of that agreement, and to recording on each customer's account which version it accepted and when.

This page is that archive. The version in force today is always the one published at mygatepass.com/dpa. Every earlier version stays available here, unchanged, for as long as any customer accepted it and for six years afterwards.

Published versions

How amendments work

We may amend the agreement in the circumstances set out in its clause 1.4, which are a change in applicable data protection law or regulator guidance, an update to Annex B, Annex C, Annex D or the Subprocessor List, or the addition of a Schedule for a new module. Any other amendment applies to a customer only from its next renewal.

Whatever the reason, we do the same four things every time:

• publish the amended version at mygatepass.com/dpa under a new version number;
• add it to the table above, with a plain description of what changed;
• keep the superseded version on this page, at its own address, so that a customer can read the version it actually accepted; and
• notify each customer's account administrator by email at least 30 days before the amendment takes effect.

Where an amendment reduces the protections in the agreement, or changes the categories of personal data processed, the residency position in clause 8.1, or the retention position in Annex C, a customer may object and terminate the affected services as set out in clause 1.4. We refund fees paid in advance for the terminated part pro rata.

Your record of acceptance

We record on each customer's account the version of the agreement it accepted and the date of acceptance. On request to legal@mygatepass.com we will provide a copy of the version applicable to that customer together with the record of its acceptance.

Where a customer requires a signed counterpart of any version, we will execute the signature block in Annex E of that version. Signing changes nothing in the terms: the signed and unsigned versions are the same document.
